La qualificazione di una disposizione testamentaria quale heredis institutio mediante attribuzione di un bene determinato è sovente resa vischiosa dalla difficoltà di ricostruire il voluto dell’ereditando, specie quando questi consegni le sue ultime volontà a una scheda olografa. La rilevanza sistematica dell’istituto, unitamente alle interferenze con altri istituti, su tutti la divisione del testatore, rimarca la centralità del procedimento ermeneutico, al fine di consentire all’assetto di interessi congegnato di dispiegarsi appieno quando le disposizioni avranno effetto.
